what can an employer say about former employees...

Do you plan on leaving your job for a new one in 2015. Here are some things to consider...

One of the questions people ask frequently is "What can an employer say about former employees?" Some job seekers presume that companies can only legally release dates of employment, salary, and your job title. However, that's not the case.

Can an employer say a former employee was fired or terminated for cause? How about saying that you quit without notice or your attendance record wasn't good? Are there limits to what an employer can say about you?

There are no federal laws restricting what information an employer can disclose about former employees. If you were fired or terminated from employment, the company can say so. They can also give a reason. For example, if someone was fired for stealing or falsifying a time sheet, they can explain why the employee was terminated. Here's information on when an employer can say you were fired.

That said, because of laws regarding defamation (which is slander or libel) companies are usually careful about what information they provide to hiring managers confirming employment or checking references. What they say has to be the truth or the company can be subject to a lawsuit from the former employee. Legally, they can say anything that is factual and accurate.

What Former Employers Can Say About You

If you have been fired or terminated, check with your former employer and ask what information they will give out when they get a call to verify your work history. If they do give out more information than the basics, what they say may be negotiable and it can't hurt to ask.

When you left under difficult circumstances, you could ask someone you know to call and check your references, that way you'll know what information is going to come out. Or, you can also use a reference checking serviceto check on what will be disclosed to future employers.

Getting the Story Straight

It's important that your story and your former employer's story match. If you say you were laid-off and the company says you fired, you're not going to get the job.

Also, not telling the truth during the application process can get you fired at any time in the future - even years after you were hired. That's because most job applications have a section where you verify the information is accurate.

Don't Presume the Company Won't Give Out Information

Don't presume that your former employer won't disclose the reason why your job ended. Large companies typically have policies regarding the disclosure of former employee information, but may not. Many smaller employers don't have a policy at all or aren't aware of or concerned about legal liability issues.

In either case, it's important to know what the employer is going to say about you, because what you say needs to match what the company is going to say.

Finally, if your version doesn't match theirs and you feel the company's story about your termination isn't accurate, be upfront and say so. You'll have a better chance of getting the job than if you say one thing and the company says another.

a friend

I could never be like her, him, or you. I learned that I could only be

Never tried to be like anybody else once I found me.

When I was created, God shaped and formed my mold

I was given earthly talents and touched with a spiritual soul

I've extending my hand of friendship to many

For I was created to be a friend...not someone you'd envy

Strong, stern...yet poised and direct

Far from the type of friend who you could be bought with a check

I was injected with love and life to share to all

You know that if you need me, all it takes is a call

Flushed with the desires and aspirations to be great

Your friendship should always be on time and never should be late

Loyalty means everything to me

A true friendship is on display for the world to see

It can be about a look...a laugh...or a tear

Your words put their minds at ease and relax their fears

People always as what they would do for their friends

The answer should be "Everything." Because we are friends until the end

What kind of friend are you? Are you the friend that I see in me

Friends last forever...through love...because it's their destiny.

me vs the COPS

In light of the recent events in this country where UNARMED young black men (Trayvon Martin, Eric Garner, Mike Brown, Tamir Rice...just to name a few), I wanted to share with you two posts about my many encounters with police in my lifetime. Based on these events, I could have ended up just like these young men.

Fuck the police comin straight from the underground
A young nikka got it bad cause I'm brown
And not the other color so police think
they have the authority to kill a minority
Fuck that shit, cause I ain't the one
for a punk motherfucker with a badge and a gun
to be beatin on, and thrown in jail
We can go toe to toe in the middle of a cell

Ice Cube (Fuck tha Police)

FIRST OFFENSE (Summer '98)

Let me start by saying that I don't like cops. I hate to generalize it but I don't like em. I don't feel safe around them, they've never been around when I've needed them, and I haven't had one nice cop pull me over. I know that they are here to serve and protect. I know that they have a thankless job. I know that 99% of cops are good people. My brother in law is a cop. I guess I'm just a magnet for the 1% of cops that are racist assholes. That said...here's my story

I was in New Orleans about 15 years ago on a business trip. My co-worker and I decided to go to Bourbon Street. If you've ever been to N.O. you know that ANYTHING goes on Bourbon Street. We hung out and had a good time and then decided to head back to our hotel. Before we got in the car, my co-worker, who is white, was complaining about his feet that were sore from walking. When we got in the car, he decides to take his shoes off to "rest his dogs." As he was bending over to remove his shoes, I see a police car behind us that throws on the blue lights. We were only a block away from Bourbon Street and we weren't drunk so I dunno why we were being pulled over. The cops get out with their GUNS DRAWN!!! They are yelling at us to get outta the car. They make us stand in front of the running car with our hands on the hood of the car. Apparently, there must be some law about a young black dude and a white dude hangin together...because they thought we had drugs on us. They asked my co-worker why was he bending over in the car...was he trying to hide some drugs? Drugs? You could get ANY drug that you wanted just a block away on Bourbon Street!!!

When my co-worker advised him that he was removing his shoe (as evidence he pointed to his untied shoes), they threatened us. It was a black cop and a white cop. The black cop said "why are you two together?" We explained but the didn't listen. They proceeded to search my car (illegally). We asked could we take our hands off the HOT hood of the car. The black cop said "No. And you better not run. If you move, I'll put a bullet in your back!!" I couldn't believe it. I looked at the white cop and he was cool. He was the one who called off the black cop from going through my trunk and suitcase. I told them that this was our first trip to New Orleans (I'm never going back) and I wondered if that's how they treat their guests. My co-worker and I gathered our composure and got back in the car. We were furious and stunned!! We just sat there for about 5 mins before we left. He said we should have gotten their badge numbers and filed a report. I told him..."I'm used to this. Nothing will happen to them." We drove up the street and the SAME cops had pulled over a car full of Mexicans. Wow! I wonder what rule did they break? F@#% the police!

SECOND OFFENSE (Fall '98)

I left Atlanta one day headed to my hometown, Florence, South Carolina, for the weekend. I'm cruising down Interstate 20 with the windows down. I'm driving through Madison County (about an hour outside of Atlanta) when I see a cop "hiding" in the bushes in the median. I look at my speedometer and it's reading at "60 mph" and the speed limit is 65. I drive past the cop. He sees me and pulls out onto the highway immediately. I saw him pull onto the highway but I didn't know he was coming after me. The next thing I know...I see the blue lights...AGAIN!!! The officer asks me for my information and I give it to him. After a few minutes, he comes back and here's what he says...

Cop: "Sir, where are you headed?"

Me: "I'm headed to Florence, SC"

Cop: "Where are you coming from?"

Me: "I'm coming from Atlanta." (Why do you wanna know asshole?)

Cop: "Can you step out of the car? I'd like to search the car...if that's okay with you, sir."

Me: "Sure. If you want to search it...go ahead." (What the hell you think you gonna find fatboy?"

I step out of the car and stand in the grass as this dude looks around my Nissan Sentra (not a Bentley but a Sentra). At this point, I'm sure that SEVERAL of my civil rights have been violated.

Cop: "Can I look in your trunk?"

Me: "Yeah." (I hope you don't see the dead body back there)

I open the trunk. Nothing back there but my bag

Cop: "Sir, can I open up the bag? I have to ask first...do you have any drugs or guns in this bag"

Me: I chuckled. "No, l left them at home."

Cop: "I'm sorry to have inconvenienced you. It's just that we have lot of drug trafficking between here and Texas. We have been cracking down on it. And you had your hat on backwards. "

Me: "I would never sell drugs."

Cop: "You are free to leave, sir. Have a good day."

I wonder what was the dead giveaway that day. Was it my hooptie? Was it the Yankees fitted hat that I had on backwards? I know what it was. And so do you. How else would somebody explain getting pulled over by cops 3 times in a week? That was my THIRD time getting pulled over in a week! I did what my parents always told me...1) be calm & cordial 2) always let them see your hands 3) never ride with more than 3 other black kids in a car because you WILL get pulled over.

I have 3 sons. What will I tell them about the police? The TRUTH. My truth...my reality. I'll tell them this story as well as my other run-ins with the cops. I would like to think things will be different for them. I doubt it. As much as we say black lives matter...the recent events prove otherwise. Don't think that it's just black people, either. This could happen to anybody...any race.

How can you matter if you're not even viewed as an equal?

laces

*repost from Jan 2010*

Sports can teach you life's lessons

I learned that early and I'm still learning it.

I remember my high school football coach, Virgil Wells, telling me...

"Son, your job is to catch the ball. You have the ability. When the ball is the air, you treat it like it's yours. You focus on it. No distractions! You don't wait for the ball to come to you. You go and get it! Your focus on the ball should be such that you see the laces on the ball the moment that it's in the air."

Coach Wells' words have always stuck with me.

When I was younger, I used to wonder if he was talking about football or life's opportunities?

Now that I've gotten older, I realized that he was talking about both. Opportunity is just like that ball. Focus.

Unfortunately, Coach Wells passed away while I was in college at South Carolina State University. I regret that I never got a chance to tell him thank you for those words. Even though Coach Wells is no longer here, I'm glad that he told me.

And I'm glad that I listened. Thanks Coach

my top 10 video games of all time

We were having a discussion the other day on twitter. My boy, Beezy, mentioned some games that he'd put in his top 10 of video games.

It got me to thinking about what would be my personal top 10.

here's my list...

10. Coach K Basketball - Long before Ed O'Bannon sued the NCAA, this game was dope because it didn't have the players names but you KNEW who the players were. You could take that '90 UNLV squad and play against Michigan's Fab 5 from '91.

I remember I drove from Atlanta to Florida to visit my boy, Moe. We played this game all weekend. I had gotten the best of him all weekend. We decided to play one last game before it was time for me to drive back on Monday. We played before he went to work that morning. I was winning by as much as 15 pts. He makes a comeback. This dude hits a 3 pointer at the buzzer on me!!! I was PISSED!!! I demanded a rematch but he wouldn't play me because he said "he didn't want to be late to work." I drove back to Atlanta...mad as hell! That was a looooong 4 hr drive.

9. Out Run / Pole Position - two of my all time favorite driving games. Out Run was dope at the arcades.

8. Pitfall - Running through the jungle was fun, cool, and dangerous. I played this game until I mastered it

7. Street Fighter - Is there anything better than whipping somebody's ass and beating them to a bloody pulp?

6. Frogger - Why did the frog cross the road? I don't know. But this was fun

5. Mike Tyson's Punch Out / Tecmo Bowl - It took a looooong time for me to get to Mike and beat him...but I did. As far as Tecmo Bowl...the 85 Bears were unreal! So was Bo Jackson

4. Space Invaders - I spent a small fortune at the arcades on this game

3. Donkey Kong - Arguably the best "soundtrack" for a video game. Mad fun!

2. Pac-Man - the ultimate classic. Whatever the top score is...I'll beat it! Nobody can beat me...including you!

1. John Madden Football - I think I've played this game for a gazillion hours...literally. The ultimate football game

Shady CXVPHER Convo with Dead End Hip Hop

It was an honor and privilege to be a part of this Dead End Hip Hop review. I appreciate the opportunity to rock with my boys.

To help build the anticipation for the new ShadyXV compilation album, Shady has put together a special series of cyphers that will showcase different members of the label doing what they do best. With home turf instead of a beat to rap on, Crooked I, Joe Budden, Yelawolf, Joell Ortiz, Royce Da 5'9", and Eminem each spit their verses a cappella. Who had the best? Let us know.
